I. This memorandum of understanding is to verify the nature of the Internet course(s) listed above, as developed by the faculty member named. This faculty member’s Internet version of the course or set of courses listed will be considered in one of the categories below.  Please indicate the appropriate status with a check:

 

_____ A. This faculty member’s Internet version of the course or set of courses listed has been or will be developed by the faculty member as part of his/her assignment at East Tennessee State University and will be the joint property of the faculty member and the university. The faculty member retains the right to future use of any materials in the Internet-based course that are his/her creations; if multiple faculty contribute materials to the course, each retains the right to future use of his/her contributions.  The department, on behalf of the university, retains the right to the Internet-based course, to have access to it, to give other instructors access to it, to schedule and offer the course at any time, to let other instructors modify and add to it, and to let other instructors teach the course or sections of it.

This faculty member’s Internet version of the course or set of courses listed has been or will be developed by the faculty member as his/her unique approach to a course or courses he/she has been or will be assigned to teach.  The faculty member retains the right to future use of all materials in the Internet version of the course. The department, college, or university will do none of the following without the faculty member’s express permission:

o       Schedule this Internet version of the course except as part of this faculty member’s assigned load.

o       Assign any other instructor to teach this Internet version of the course as this faculty member has developed it.

o       Modify the content or allow other instructors to modify the content of this Internet version of the course.

o       Allow anyone to access this Internet version of the course other than the faculty member, his/her students, and authorized university personnel.

o       Make any use or distribution of the materials in the Internet version of the course in any format.

 

 

(Please note that other faculty members/instructors may develop other Internet-based versions of this course or set of courses. This category pertains only to the unique version developed by the faculty member submitting this form.)

 

II. Neither the faculty member nor the university shall sell, or allow to be used by any outside entity, a version of an Internet course, or any parts thereof, without first establishing the mutually agreed terms of such a sale or use.

 

 

III. Complete and attach to this document the form for Disclosure of Materials to be Copyrighted as established by the Office of Research and Sponsored Programs
